Am I wrong to ask for a refund?

I'm going to copy and paste my posting over at PWCT just because it's much easier. But I would really like some clean, honest opinions of whether I was wrong to ask for a refund on a fallen through deal. Thanks in advance for your thoughts.

Hey everyone, I have a small issue with a seller on here and I am wondering what your thoughts are. Here's the deal, I bought a F/A from this guy, good guy and good price. The cost of it was 8 bucks as you will see in the message history. I blurred out his info because I don't want to slam him, I just want some honest input on the subject. So anyway, I buy the F/A for 8 bucks, plus 23 for shipping to get it here. I never thought to ask how he was sending it...my fault, but he also never asked how I wanted it sent...neutral score.

He sends the package by UPS, puts an insurance value of $212.12 on an 8 dollar item. I get the parcel and it comes with an added $87.++ bill attached, 55 for brokerage fees and the rest was for taxes. I tell them no way, not for an 8 dollar item, send it back. So they take it back, I tell the seller about what happened that night and told him what to expect. He tells me he will keep me updated...as you will see. Weeks go by and I hear nothing, about a month later I wonder what's going on, the tracking on the package says it's stuck not far from me in transit. I call UPS and ask why he doesn't have it yet. They tell me they called him about it, his "wife/mother/gf/sister" whatever declined the package as well and left it abandoned right after I backed out.

So I call them back a few hours later asking if there's anything I can do to get what's mine back to me but having the insurance corrected to the honest value of the contents inside the box. They say it's all in his hands and up to him to do that, being the collector I can't have power over the shipping. I tell him this and he says he will look into it, 3 weeks go by again with no response. Then I message him again, another week goes by with and today I get a response as you will see...two responses actually. The bottom line is, right from the UPS rep, they keep abandoned packages for 37 days before they can't be reclaimed. Now I'm out by parts and the money for both the parts and shipping, he claims he paid for the shipping but you will see where he added it onto the price in the first couple of messages. What does everyone here think? Do I have an honest case here or am I at fault for how things went down?

You deserve a refund but getting one is another story.
UPS over the border sucks big time. We get raped royaly with the brokerage fees.
 
I have been considering talking to paypal about it. It's a low loss but still a loss I shouldn't have to deal with in my eyes. And yeah I just found out last night about his name still being on one pic lol. I'm not going to bother editing it, I sent him a message before I posted this asking if he would relax and be willing to meet me half way with some sort of agreement but he ignored it. So I guess it's best the truth be known anyway, I tried to be reasonable but what can ya do.

Anytime you ship an item to canada UPS charges a flat rate brokerage fee for handling the transaction. Thay's why I no longer offer ups to canada and now just use usps priority flat rate boxes.

I thought there was a low limit exemption though? Under $20 was exempt?

At the very least I think you deserve the item you purchased. Reimbursement on shipping fees is tricky across borders. Shipping fees due to a shippers mistake are his responsibility and vice versa. There should have been no fees to him to take the package back so I don't understand why he denied it. Ordinarily I would say he should have received it and reshipped it usps on his dime but its possible he didn't understand how to go about the process with customs.

How much dialog did you guys have regarding how the item was to be shipped in the first place? How much knowledge did either of you have on the topic?

There is but he insured it for $212.00 so NO MORE exemption. I would file a pp claim FOR SURE. I ship everything USPS reular to Canada with LOW value and NO insurance. It is a risk but cheapest route and havent had an issue yet.

Definately file with paypal before its too late. You can always cancel the claim if it gets resolved in the meantime.
 
You should post in the "Negative feedback" section so someone else doesn't go through the same situation with him. You don't have to bash him in the post, just lay out the facts and your experience dealing with him so that someone can make their decision to deal with him based on that. Rate him on a scale of 1-10.

never heard of a fee like that, then again i have not personally sent anything outside the states
where i used to work, i had paper work to complete, but the shipping dept handled it

also.... i am not into getting used stuff (where i can avoid it)
been BURNT many times in the past with car stuff, i don't risk it anymore, but of course there are exceptions to that

I just had to go thru my FIRST PP dispute. Went INCREDIBLY SMOOTH and I have my funds back in my account in a matter of 30 minutes. I sent the item back with tracking ( I am still out that cost). When it arrived to them (yesterday) and I didnt get paid back instantly, I filed a claim about an hr ago, i got an email asking for proof of return shipment 10 mins. later. I supplied the tracking # and had the $ back in my account 20 minutes later. WOW. I am still out $9.30 for returned tracked shipping but it beats the $152.50 it was I guess.

I assume the item's condition was fine, I didn't get to open the package because I didn't have the 87 bucks for brokerage fees so they took it back to their outlet. Initially I paid him the 23 he quoted me for the shipping and I assumed that's all there was to it. I must admit I did expect there to be something else in the range of 20-30 for brokerage fees which I was fine with, but because he declared the contents to be over 200 in value that pushed the brokerage fees up to 87. I told them I can't afford that and can't justify paying almost 90 bucks for an item that cost me 8. When I spoke to the UPS rep, she said that he's not supposed to be declaring more than the actual value of the parts and the only way for it to be corrected is for him to call it in and make the adjustments. I told him about it in a message just minutes after getting off the phone with her but he left it alone for over 3 weeks and the opportunity expired leaving me high and dry. I don't think I'm going to file anything with PP just because it was a pretty small amount to lose. But if he had any sort of a conscience he would be willing to work with me on the matter and not against me. I messaged him after his last reply (the one shown in the pics where he's yelling at me) just to try and reason with him and hope for a happy medium to be met but he ignored it and went offline. What can ya do through right? Just post the experience and hope that others don't get caught in a similar mess.

That's the gray area, neither of us spoke about the shipping method, I assumed everyone knew not to use UPS but in the same regard I also assumed nobody would declare a package to be 26.5x it's honest purchased price.

i should slap you around , i can give you f/a for free , is it for a mikuni carb, or are you looking for the kawasaki stock f/a arrestor for kehein carb , when buying from the states always ask what shipping they are going to use and have them send it united states postal service, even spell the words words dont use the short forum,and for our americian friends its no problem to send parts up to canada just dont use ups becasue of the brokage fees that they charge us

This just sounds like the seller was up to something with the 212. ins

Man Im never going to ship anything UPS to the great white north.

It was for a Mikuni SBN44, but I modified an OcenPro Vortex I had on my Sea-Doo. It's been working alright so I'll just stick with it for now.
