Busted!! I am a criminal - CONCLUSION***

I was sitting in court the other day listening to the first trial, a man in cuffs and county attire was accused of domestic violence, crack possession, and lewd conduct. I found the case interesting and guiltfully entertaining as I sat and waited my turn.

Next up was a younger male being arraigned for petty theft. It seems he could not afford to pay for the case of Red Bull he attempted to take from a local store, that he was supposed to buy for a graduation party. Unfortunately he also had an illegal pocket knife on him that he "found in the street just moments before his lapse of good judgement regarding the Red Bull", as his lawyer put it. Wow, what a string of 'bad luck' for this guy...

Then they call my name for arraignment. The judge asks me to come to the stand and reads my Misdemeanor charge of failure to wear a USCG approved life jacket while riding a PWC. The ticket states I was wearing a lifejacket, but it was not a USCG approved lifejacket, therefore I am being charged with a Misdemeanor for no lifejacket in accordance with Michigan law. Penalty for this crime is $100 fine and/or 90 days in Jail. I am out on a $1000 personal bond - no joke.

I am a hardened criminal in the eyes of the State of Michigan, facing jail time for grabbing the wrong life jacket. Shame on me. Let this be a lesson to all of you... if you are going to use a non USCG approved lifejacket in Michigan, you might as well smoke crack or steal a case of Monster, since the punishment is no different.

Michigan recently passed a bill (4143) that decriminalizes many PWC infractions, making them a Civil Infraction. Such as: riding in water less than 2' deep, jumping wakes less than 150ft from boat, excessive speed, reckless endangerment of wildife, riding too close to a swim area, etc. Nothing regarding a lifejacket, though.

I'll let you know how it turns out. Have to meet with the prosecutor in 2 weeks, before the trial, in an attempt to get this reduced to a CI and be done with it.

The really sad part is that we were sitting in a shallow area in a no wake zone not bothering anyone, just relaxing. Cop came up and said "let me see your life jacket". From that point on it was like an episode of COPS.

That is pathetic. It should be a ticket of $50 at very most... Nice to know your tax dollars are spent writing tickets for lifejackets when not even riding.

And I'm all for on water safety, but come on.

yeah it sucks, yeah you were sitting in a shallow no wake zone not bothering anyone but the fact of the matter is you were not in compliance with the local regulations...

you i know cops can be a pain in the ass sometimes.... but it burns me up when people complain about getting a ticket for not complying with silly stuff like not having enough life jackets for the amount of people on board, riding a ski that was not registered that was found on the side of the road, or not wearing the proper life jacket.

5 minutes of your time before hand could have prevented spending half a day in court and and putting up a 1k bond.

sure i may sound like a dick for saying what i have said but thinking before you ride saves you a lot of aggrevation.

You are correct, you can ensure every breath you take is legal and there is a good chance you may not get an invitation to spend some time in court.

However, I think I am making a point concerning the severity of punishment for the offense, and not the fact that I was in violation, regardless that the crime I committed against the state and the fine people in it was a mistake, not a intended or deliberate action - to which there were no consequences or endangerment to anyone other than myself (potentially). And I was wearing a full vest, buckles and all. Just didn't pay attention to the lack of USCG rating, and the store I bought it at didn't highlight that fact either. Call me ignorant.

It's also worth noting that I can ski or wakeboard behind a boat without a lifejacket, legally. I can also refuse a breathalyser when suspected of intoxication above legal limits, and only get a Civil Infraction. I can also operate a boat at high speed in the immediate vicinity of a diver, and only get a Civil Infraction. If I am really having a really bad day, I can drive a boat through a marked swimming area and get slapped with a lesser charge of a Civil Infraction.

I guess this all makes perfect sense, huh...

true, but was the 5 minutes to get another vest worth the day in court and 1k bond?

nope.... who would have thought that would happen though????

kinda unreasonable to assume you will be arrested for that... at least to me...

In the end... It's his fault...

..I still think the pig is still an asshole for taking it that far.
A verbal warning and a tounge lashing would have been enough to
get him in line....

that sucks man. I spend all last year fighting a misdemnor for making a u turn. in the uturn there was a sunken manhole cover which caused my tires to make a little chirp. He got me for exhibition of speed, if you dont know is a racing crime. It is for showing off and doing burnouts and the like or racing down the street. Luckly i didnt have to hire a lawyer, but i had about 4 i was talking to. Some laws are sooo stupid!!

I had no numbers, lanyard, fire extinguisher, or registration w/ me and my trusty "high air quality" sticker.... still got all love from Fish and Game....

The cop was like: "you are probably one of those guys who puts their weed in a purple Crown Royal bag"... we chuckled and went on our way...
