Exactly that .Whether he sues or not his racing days are most likely over .
It's my personal feeling (from experience) that websites allowing threads where comments are made on pending litigation items open themselves up for possible legal probelms, so I'd bet that's why the thread was pulled from PWCtoday. Can't say for sure as I resigned over there a couple of months ago, but I do know that was the course taken when Mr. Kenney was injured.
I would expect that you are covered by the Webmaster's Act of 1998.
I'm frustrated that folks choose to comment either way regarding both of these individuals when there is pending litigation and none of you know the specifics of the lawsuit, much less why things must be done a certian way. It's safe to say poor Mike isn't the only one named in the lawsuit, and it's also safe to say unless you've walked a mile in Trace's shoes you have no clue what he's dealing with.

Lisa, This was at a race. Accidents happen, "IF" there is a lawsuit. It is crap. That is like suing your engine builder because your engine let go during a race........
You accept any and all risk when you pull up to that rubber band.
I spoke with Mike earlier. Not gonna go into details. But the fallout from this cannot be good........ If I was a promoter, you can bet that I would be thinking about a new career now.
