Mike Young getting sued... This is BS!!!

I don't know much about racing but if something hinges on one lawsuit then it wasn't properly set up to begin with. It was only a matter of time and it should have been considered a long time ago and dealt with via insurance. And I'm sure it was.

That being said I would say this is BS and if I was a promoter I would probably bail too. Insurance or not.

How is insurance going to cover the Lawyer fees???? Yes, he would have insurance (Liability) that should cover the plaintiff if said asswipe does win. But his out of pocket expenses would put him under........

The crappy part is, you sign a waiver before you race accepting any and all conditions. But with the way the courts are today.... who knows.
 
doesnt everybody sign something that says whoever is not liable for injuries or harm done on the course???

im just speaking from experience in region 8 we sign something that says if we get hurt...its our fault...not the promoter or whoever

every promoter uses the same waiver from the APBA for this kind of thing.

it's schitty deal all around stuff like this is why the sport dying out.... someone doughnuted up, raced with out insurance, got hurt, and is now suing whoever they can in order to cover the medical bills

Yes, we do. That does not stop someone from filing a lawsuit.

Actually BK, the insurance company for the APBA does cover out of pocket expenses for defendants. Doesn't make it any less stressfull for any of the folks involved, but it does make my point:

Unless one is a party to the proceedings, one probably shouldn't be commenting in a manner which infers they know all of the details...and that's all I'm going to say because that's one of the few details I know to be fact.

Racing with out insurance has nothing to do with it. With or without don't blame someone else for what you should take full responsibility in a dangerous extreme sporting event.

If the course layout was dangerous then someone should of spoke up with a concern.

I remember at one of my races. World champion Craig Ingram took a wrong turn on a Closed Course track and ended up right in front of me. I ended up T boning his ski making a huge hole in each side under his seat. Lucky he or I didn't get hurt. However his ski had major glass damage and I got lucky with mine. It just chipped the paint on my gpr.
But in the end that's racing, things like this happen.
Craig has been racing over 20 years, he said he went to the wrong buoy and bamn. Oh yea he still won that race.

That is one major reason why more people don't race, they don't want their skis damaged.

Its a bad deal for both sides.

It may not be as simple as that. In Trace's defense, if there is one, his medical expenses could cripple him financially for decades. Suing Mike is what he considers to be his only salvageable solution. Mike may have to stop promoting but Trace can move on to a functional financial life.

Does that make it right? No. Being involved in a dangerous hobby and not having health insurance is completely unacceptable. Too many people learn this the hard way.

He could also end up with lawyer bill's on top of medical bill's and loose the case. I do not know this person or anyone involved however it is not good for the sport.

I now Trace from our ride spot.His family has cash and he is a young kid So his parents should have had ins on him if he did not have it.

I carried my 23old daughters ins all thru colledge and untill she got a good paying gig

We all know its not if its when.

get covered and stop going to court because you screwed up

So his solution is to drag down someone else instead? It's a terrible thing that happened, but he new very good and well what risks are involved with this kind sport. It just seems like nowadays, when you screw up....the solution is to try and make someone else accountable. I see your point about desperate times, but I don't think trying to shift the blame, and the expenses to someone else is the answer or anywhere near the correct thing to do.:crutches:

I dont know any of the partys involved here. I just want to say I checked with my insurance rep. of my aflac, not my work medical coverage, before going to the Jam back in 2004. The aflac has a diclaimers on racing in a sanctioned event. My question was, your racing agaist the clock on the closed coarse and or what if a WP gives me a ticket, after an accident saying I was racing during anytime on the water that weekend. The rep. tryed to laugh it off untill I pressed him and and he stopped short of saying you would not be covered.
