Update: I got a response from Scott at the IJSBA that he will look into it. I also got an update from the president with the latest developments. Here it is:
" For Immediate Release
The Leander Sports, Entertainment and Destination Center (SEDC) and the Texas X Park (TXP)
March 28th, Leander Texas
The Development team, Leander Capital Investors, of the SEDC and TXP has successfully been granted their Nationwide Permit #14 from the US Army Corps of Engineers (Fort Worth District), for the crossing of Jurisdictional Waters under Section 404 of the Clean Water Act.
This permit secures all environmental issues, giving the Leander Capital Investors the green light for their development.
The development team is very glad to receive this permit in such a short time, a testimony to their efforts in working closely with their consultant team and the US Army Corps of Engineers.
Under the Nationwide permit, the developer was allowed to affect the crossing of Jurisdictional Waters by as many as 22,000 square feet. The development team worked and re-engineered their site plan and is now affecting 8,000 square feet .
This is a very serious environmental design effort given the magnitude of the development (205 acres). It shows that the developer has tried inasmuch as possible to limit the areas to be affected, with a healthy and secured environment constantly in mind. Also concluded was the developer’s tree survey, and the team has been working hard to keep as many trees in place as possible.
According to Matt Tolbert , “Our development team has acted very responsibly with regards to the environment. The Texas X Park is going to be an environmentally friendly development that we all can be proud of and enjoy for many years to come.”
