Used Nightrider05

I bought a used MSD enhanser from Nightrider05 early this year, and put with the other parts I bought getting ready for some upgrades. Cool guy on the phone I even put a nice thread about him. http://www.x-h2o.com/threads/107761-Nightrider05-thanks&highlight=

So after talking to DK he told me that the enhanser was not working correctly it would adjust but the high was about 2000 rpm's too low. He tested it against a brand new unit, and it was not working right. I told him to put in a new one.

That nite I called Nightrider05 and started to leave messages. He called me back and immediately tried to tell me I was wrong.

When I got the package and opened it I thought that he could have done better packing it. So apparantly it was damaged during shipping.

I am a regular on here and he sells a bunch of parts on here.

His message to me says he will not refund my $200.00 for the part he packed poorly and was damaged during shipping. I know there was a little delay in getting it installed while I waited for other parts.

I am a business owner for many years and I know THIS IS ONE OF THOSE SITUATIONS THAT HE SHOULD STEP UP.

Not trying to flame too hard good guy making a bad business choice. Jason please just refund my $$$ I will send you back the unit.\

Here is my rebuttal as alot was left out.

Here are the facts:

This part was pulled from my personal ski that was running fantastic up until the part was sold.

I sold the part to Bill back in early February and transaction went good. Positive feedback was left for me from Bill either in a new thread as seen below:

I was contacted by Bill about 3 weeks back(late May) after not having heard from him for months.

Bill gave me a few details before he said that he was sending it back and that I was going to have to "man up" and refund his money in the first phone conversation. This is not the proper way to talk to anyone, no matter what the scenario. I did not immediately tell him that he was wrong as he stated above. I did tell him that he was putting me in a bad situation since he decided to wait 3+ months and wants a refund, on a part that was fully functioning when I sold it.

Bill mentioned that it could have been damaged in shipping..however he had never once mentioned this before. I typically insure all packages even if the buyer does not request it. However by the time he contacted me there was no chance of doing an insurance claim. He thought that maybe the rev limiter knob had been damaged in shipping. This thread is the first time he has bothered to show me any pictures at all.

It was a rather heated conversation after that which I ended by saying I wanted to gather some facts and get back with him. I consulted a few business owners and got their opinions on this situation..one business owner is actually a shop owner that does watercraft repair and he personally rode the ski a week before it was tore down and parted out. He will even vouch that the ski was running perfect.

My final decision was that too much time had passed, and I know the part was working when removed and shipped. If he truly felt that the item could have been damaged in shipping then it was his responsibility to contact me in a timely manner so we could get the ball rolling on a claim. The box was of sufficient size and with a sufficient amount of packaging to accommodate the MSD enhancer.The item was sold with no warranty as with any known working used electrical item. I do not know the level of knowledge of the installer, and can not cover installer errors.

I do my best to please all customers and this situation has indeed bothered me. Between Ebay, PWCtoday and here on X-h20 I have over 500 transactions with ZERO negatives. I am sorry that this transaction ended this way, but I do not feel that I was in the wrong.

You were not in the Wrong until you said that you were not going to do anything about it.

The conversation when I said you need to man up and take care of this was after you made it clear you had no responsibility in this matter.

I left possitive feedback because I thought you were a good guy and it was nice talking to you.

If you have had over 500 customers with no complaints great that is why You need to do the right thing here.

I am not here to say you are anything but a guy selling parts, you a member of this forum and so am I.

As I told you on the phone in the business world things like this happen between honest people, and the guy with any sence of business etique will step up and do the right thing which is refund my $$$ for your part that is damaged.
