new 44,s are they defctive

I just bought new 44,s and when I check the pop off.The one carb the needle jams up.It gets on an angle in the seat and stays open even when the cover is on.The arm was in the right position just above level. I have astock 38 doing the same and I bent the arm down to level didn't help

i have that happen before
it turned out to be a propblem with the n/s
it was jamming
prove it by putting another n/s in there and checking it
